The Website

The purpose of these General Terms of Use (hereinafter, “Terms”) is to regulate access to and use of the Website.

ESARODA, S.L. reserves the right to modify, at any time and without prior notice, the presentation and configuration of the Website and the Content and Services that may be incorporated therein. The User acknowledges and accepts that at any time ESARODA, S.L. may interrupt, deactivate and/or cancel any of these elements that are integrated into the Website or access to them.

Access to the Website by the User is free of charge and, as a general rule, does not require payment, except for the connection cost through the telecommunications network supplied by the access provider contracted by the User.

The use of any of the Content or Services of the Website may be subject to prior subscription or registration by the User.

User

Access, browsing and use of the Website (as well as spaces enabled for interaction between Users, and between the User and ESARODA, S.L., such as comments and/or blogging areas, if any) confer the status of User. As such, the User undertakes to use the Website and the services made available through it in accordance with the Law, morality, generally accepted good customs, public order and the provisions of this document.

Consequently, the User agrees not to use the Website for illegal purposes or effects and/or purposes contrary to the provisions herein, harmful to the rights and/or interests of third parties, or which may in any way damage the Website or impede its normal use, or that of the services accessible through it.

The use of the Website and/or its Services will imply full and unconditional acceptance, and validity, of each and every clause included in the most recent updated version of this Legal Notice, so the User should be aware of the importance of reading them each time they visit the Website. Likewise, it does not constitute the establishment of any kind of commercial relationship between ESARODA, S.L. and the User.

Access, browsing and use of the Website, as well as spaces enabled for interaction between Users and ESARODA, S.L., such as comments and/or blogging areas, confer the status of User, and imply acceptance, from the start of browsing the Website, of all the Terms set out herein, as well as their subsequent modifications, without prejudice to the application of the relevant mandatory legal regulations, as applicable.

Given the importance of the above, Users are advised to read them each time they visit the Website.

ESARODA, S.L. reserves the right to remove any comments and contributions that violate the law, respect for human dignity, that are discriminatory, xenophobic, racist, pornographic, spam-related, that harm youth or children, public order or public safety, or which, in its opinion, are not suitable for publication.

In any event, ESARODA, S.L. will not be held responsible for the opinions expressed by Users through comments or other blogging or participation tools that may exist.

In compliance with current legislation, this Website of ESARODA, S.L. is addressed to all individuals, regardless of age, who may access and/or browse its pages.

 

3) INTELLECTUAL PROPERTY

To protect possible intellectual property rights, in the event that any user or third party considers that there has been a violation of their legitimate rights by the introduction of certain content on the Website, they must notify ESARODA, S.L. indicating:

  • Personal details of the interested party who is the holder of the allegedly infringed rights. If the claim is submitted by a third party other than the interested party, the representation with which they act must be indicated.
  • Indication of the content protected by intellectual property rights and its location on the Website.

ESARODA, S.L. applies the utmost diligence to ensure that the data and information offered on its website are updated at all times. However, it does not guarantee nor accept responsibility for the accuracy and timeliness of the content of the website, reserving the right to modify such content at any time. ESARODA, S.L. is also not responsible for information that may be obtained through links included on the website.

Commercial relationships between clients will be governed by the general conditions that, if necessary, are established by ESARODA, S.L. in a specific document for that purpose, or by specific agreements that may be made with clients.

 

5) INFORMATION AND COMMERCIAL ADVERTISING POLICY

ESARODA, S.L. undertakes not to engage in misleading advertising. For this purpose, formal or numerical errors that may be found throughout the content of the various sections of the Website, produced as a result of incomplete maintenance and/or updating of the information contained in such sections, will not be considered misleading advertising. ESARODA, S.L., in accordance with this section, undertakes to correct such errors as soon as it becomes aware of them.

ESARODA, S.L. undertakes not to send commercial communications without identifying them as such, in accordance with the provisions of Law 34/2002 on Information Society Services and Electronic Commerce. For this purpose, all information sent to clients of ESARODA, S.L. that has the purpose of maintaining the existing contractual relationship between the client and ESARODA, S.L., as well as the performance of information tasks and other activities inherent to the service contracted by the client, will not be considered commercial communication.

If you receive communications by these means (emails, automated form responses, and other communication systems), please note that the messages are intended exclusively for their recipient and may contain privileged or confidential information. If you are not the intended recipient, you are hereby notified that any unauthorised use, disclosure, and/or copying is prohibited under current legislation.

In accordance with Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce, and Directive 2002/58/EC, we inform you that if you do not wish to receive commercial communications and information via this electronic communication system, please notify us via the same channel, indicating in the subject “UNSUBSCRIBE COMMUNICATIONS” so that your personal data is removed from our database. Your request will be processed within 10 days of its submission. If we do not receive an express response from you, we will understand that you accept and authorise our company to continue sending the aforementioned communications.

The User or third party who makes a hyperlink from a different web page to the Website must know that:
